Terms of sale

These terms apply when you use this site or pre-order a G Hands from Castro Medical Devices LLC, doing business as G Hands (“G Hands”, “we”, “us”). Each order is governed by the terms in effect when you placed it, together with the refund statement you ticked at checkout. Nothing in these terms limits rights you have under consumer protection law that can’t be waived.

Pre-orders and payment

A pre-order reserves a G Hands from an upcoming production batch. You pay the full price, estimated shipping and any sales tax at checkout, in US dollars. Payment is processed by Stripe.
Buyers must be at least 18. A parent or guardian can order for a younger player.
Colours in photos and the 3D preview are approximate, and prototypes shown on the site may differ in small details from production units. If we make a change that materially affects what you ordered (its size, function or your chosen colour), we’ll email you before shipping and you can cancel for a full refund.
We may refuse or cancel an order, for example a suspected fraudulent order or one placed at an obviously wrong price. If we cancel, we refund everything you paid.

Shipping and delays

Pre-orders ship on a rolling basis as production batches are completed, and we email your tracking number when yours ships.
If we can’t ship your order within 30 days of when you placed it, we’ll email you before then with a revised shipping date and your options: keep your order, or cancel it for a full refund of everything you paid, including shipping, tax and any Charity Edition donation. If we can’t give a revised date, or a delay runs past the date we gave, we’ll ship only with your consent; otherwise we’ll cancel and refund you in full. Refunds go back to your original payment method, normally within 7 business days.
The shipping charge you pay at checkout is an estimate based on your country. If actual shipping costs more, we won’t charge the difference without your express agreement, and if you don’t agree you can cancel for a full refund.
Outside the US, import duties, customs fees and local taxes are not included and are paid by you on delivery. Refusing a shipment to avoid them doesn’t entitle you to a refund of the item, and return shipping may be deducted.
Please check your shipping address at checkout. We aren’t responsible for orders delivered to an incorrect address you gave us, but we’ll help you track it down.

Refunds: all sales are final

Pre-orders are non-refundable, except:

where a refund is required by applicable consumer protection law, including the shipping-delay rights above and, for buyers in the UK and EU, the right to cancel an online order within 14 days of delivery; or
if your G Hands arrives damaged, defective or not as described. Email info@theghands.com within 30 days of delivery with your order email and a photo, and we’ll repair it, replace it or refund you, including the original shipping. We’ll send a prepaid label if we need the unit back.

Defects that appear later are covered to the extent consumer law provides. We don’t cover wear, damage from misuse, or changes you make to the device.

Charity Edition

For each Charity Edition sold, 10% of its price ($4.00 per unit) goes to the charity matched to the colour you chose. Shipping and tax aren’t part of the donation.
We make the donation; you aren’t making a donation yourself, so your purchase isn’t tax-deductible.
The donated portion isn’t refunded unless the law requires a full refund, as in the shipping-delay case above.
Charity names identify where donations go. Listing a charity doesn’t mean it endorses G Hands. Ask us at any time how much has been donated to each charity.

Safe use

G Hands is a fitness and training product. It is not a medical device and is not intended to diagnose, treat, cure or prevent any disease or condition. If you have a hand condition or are recovering from an injury, talk to your doctor, physical therapist or certified hand therapist before you start, and follow their guidance on resistance, reps and rest. Stop if you feel pain, numbness or tingling. Children should use G Hands with adult supervision.

Liability

To the extent the law allows, we aren’t liable for indirect or consequential losses, and our total liability for an order is limited to the amount you paid for it. This doesn’t limit liability for death or personal injury caused by our negligence, for fraud, or any other liability that can’t be limited by law.

Using this site

Don’t misuse the site, for example by trying to break into it, overload it or interfere with checkout. The G Hands name, logo, designs, photos and text on this site belong to us or our licensors; the 3D anatomy model is used under the licences credited in the homepage footer. Exercise routines and research summaries on the site are general information, not medical advice.

Governing law and disputes

These terms are governed by the laws of the State of California, USA. If we can’t resolve a problem by email, either of us may bring a claim in the state courts in Marin County, California, or the federal courts for the Northern District of California, or in small claims court where you live. If you live in the UK or EU, you also keep the protection of your local consumer law and can bring a claim in your local courts.

Changes

We may update these terms for future orders. We’ll change the date at the top of this page when we do. The terms you agreed to when you ordered keep applying to that order.
